Greetings! We are pleased you have purchased our services. We value your patronage, and as such, we would like to make clear the terms of our services. Read this document thoroughly to understand our terms and conditions.

Terms And Language

Here are a few terms within this agreement that will be used and their meaning.

When we use the words “we”, “our”, “us”, etc. In this agreement we are referring to TrulyForms.

When we use the words “service(s)” we are referring to any present or future service(s) provided by TrulyForms.

When we use the words “you”, “your”, etc. we are referring to you, our valued customer and/or the account holder.

At some point in the future, we may update our Terms of Service. Our terms of service will always be available at the following: www.trulyforms.com/termsofservice. We may also attempt to contact you to notify you of any updates to our terms of service.

Usage of our services, presently or in the future, means you agree to our latest terms of service. At times we may not enforce certain provisions of our terms of service. Please do not infer that because we do so that we are waiving the right to enforce a provision. These terms do contain a limitation of our liability.

Security

  1. You are responsible for maintaining the security of your account and password. We will not be held liable for any losses and/or damages related to a failure on your part to secure your account and password.

Payments

  1. All payments for our services are payable upon signing up for our service(s).
  2. Our prices do not reflect any applicable fees and taxes. If we are required to do so we will collect such fees and taxes at the time of payment.
  3. We attempt to be fair in our refund process. We will refund your first 30 days of service regardless of the plan. Afterwards, we offer a refund for your most recent monthly payment if you are on the monthly plan. If you are on the annual plan, we offer a pro-rated refund. Furthermore, you may always contact our support team if you feel a refund is not suitable.
  4. Our billing cycle starts the day you sign up for our services. The monthly billing cycle is approximately 30 days and the annual 365 from sign up.
  5. If you have a credit card on file with us, we will charge your card on file according to your plan’s billing cycle. If the transaction is rejected or otherwise fails, we will attempt to charge again after a sufficient grace period at our discretion.

Termination

  1. If you wish to cancel our services, you may do so at any time. You may cancel by emailing us or filling out a cancellation request.
  2. Your information may be maintained for a period of 120 days after which we cannot guarantee your information will be accessible again.
  3. We may suspend or terminate your account for abuse. Suspension means that you will not be able to access your account for a period of time. Termination means you will not have access to your account at all. We rarely use these provisions but if we do need to, we will. We may refuse service to anyone for any reason.

Modifications

  1. We sometimes change the prices of our services. Typically, existing customers will be exempt from pricing changes. If we make changes, we will attempt to notify you by email 30 days before any changes take effect.
  2. Our support for previous versions of our services our limited. We may maintain some services indefinitely. We reserve the right to make changes to improve our services offered to you as we see fit. This may mean that some services are discontinued temporarily or permanently.

Service Availability

  1. We do not offer service-level agreements. Your use of our services is at your risk. However, we do our best to maintain high availability and uptime.
  2. As part of our services, we may back up information, encrypt data, and/or establish redundancy. We do our best to secure this information.
  3. We may need to access some information to help you or to improve our services.
  4. We use third party vendors to provide our services to you.

Limitation of Liability

We have previously mentioned liability within these terms. Here we would like to define what we mean.

  1. The services offered by TrulyForms are governed by a limitation of liability. Specifically, you agree to not hold TrulyForms liable to you or any third party for any damages accidental, incidental, direct, indirect, special, consequential, punitive or otherwise including but not limited to any loss of profit, goodwill, data, intellectual property, arising out of: (i)the usage our service or lack thereof; (ii)unauthorized access to or alteration of any your data whether stored or transmitted; (iii)reliance upon any third party statements or conduct on usage of the service; (iv) any other relevant matter relating to these Terms of Service such as: a breach of contract, tort whether passive or active, or other idea of liability.
  2. To explain in more plain language. Your usage of our services is at your own risk. We do our best to provide a safe, secure service to you, but usage of our services is strictly at your own risk.
